IELTS and Canada Immigration

One of the most common questions I get of late is about International English Language testing System (IELTS) and Canada Immigration.

Clients would ask me if it is necessary to take the said language test before proceeding with their plan to apply for New Federal skilled workers Class where there are only 38 high demand occupations being processed.

The answer is NO. IELTS Examination is not mandatory.

To show proof in your proficiency in the English Language you have two options:

# 1. Take the IELTS Examination.

# 2. Submit a written explanation detailing training in and usage of English Language. You must provide supporting documents like training certificate and other certifications showing the use of English language (i.e. from school registrar, employer, etc)

The difference between the two is as follows:

IELTS examination result is conclusive while the other option is subject to Visa Officer's evaluation. If you can clearly establish your language proficiency level by means of alternative documentation, you don't need to take the IELTS examination.

But what if you have submitted alternative documents and you were still required to take the IELTS examination?

In that case, the most logical thing to do is take the IELTS examination!

What you should do:

* You should make arrangements for testing by an approved organization. You will have to pay the costs. To check the IELTS testing center near you click this link.
* Include the results of your test with your immigration application.

What Happens Next:

* The test results will be used by CIC as conclusive proof of your language skills.
* You can use language test results for one year from the time you took the test.

What happens if you don't take the IELTS examination?

Based on experience of processing Permanent Residents Visa application, you will only be given 8 points on the average.

The maximum points for English Language proficiency is 16. Below is an illustration on the score that you should get on your IELTS Examination result per area to get full points for your English.

Speaking-6.5 to 9
Listening-7.5 to 9
Reading-6.5 to 9
Writing-6.5 to 9

IELTS or proof of the English examination will be required on the second stage of your application for Permanent Residents Visa application under Federal Skilled Workers Class.

If you have a pending PR Visa application and is still waiting for the embassy notice to update your documents, it is best that you prepare yourself for the IELTS Examination.

If you are a prospective immigrant who has concerns about IELTS and Canada Immigration I suggest that you take an IELTS Review and Test Simulation before writing the IELTS Exam even if it is not mandatory.

Important note: IELTS has two options for the reading and writing tests. There is a “General Training” and an “Academic” option. You must take the “General Training” option.

Centralized Intake Office (CIO)

With the changes outlined in Immigration Minister's instructions published last November 28, 2008, you will be eligible to sent your application under Federal Skilled Worker (FSW) category if: (1) you have an Arranged Employment Opinion (AEO), or (2) you are a foreign national who has been living legally in Canada for one year as a temporary foreign worker or an international student, or (3) you are a skilled worker who has at least one year of experience in one or more of the high demand occupations or what is now commonly called Canada's List of 38 Occupations.

Of the three options number three (3) seems to catch the attention of a lot of applicants of late, especially Overseas Filipino Workers. All Federal Skilled Worker class application without an AEO will now be processed at Centralized Intake Office (CIO) in Sydney Nova Scotia.

To have a better understanding of the program here is an explanation of the current processing system.

To process your application it is prescribed by the Canadian Government that you complete the forms and the documents needed.

Right after doing this your application will go through three stages:

1. The forms will be sent to the Central Intake Office(CIO) in Sydney, Nova Scotia Canada.

You would have to pay the courier fee to send the forms.

The role of this office to is review your application to make sure that:

•all required fields in your application forms are complete and

•the correct processing fee payment has been made

The CIO will not accept cash payments for the filing Fee they will only accept Managers Check in Canadian currency addressed to the Receiver General of Canada.

After this we will receive a Notice of Assessment from CIO

• notifies you of this fact and provides you with your reference number and sets out some basic instructions for contact with the Visa Office

2. The Visa office (Canadian Embassy in Manila) then requests that you to submit a copy of your application and all supporting documentation to a Canadian Visa Office within a timeframe of 120 days (4 months)

It is at this stage that you may file the remaining members of the Family if you chose to file just the Principal applicant during the first stage of your application. Since the Embassy only assesses the chances of the Principal applicant, filing the rest of the family at this stage will not result to delay on the processing of the application.

Once the Visa Office has received your full application, an officer will:

•Review your application to ensure you have submitted all the required documents

•Send you an Acknowledgment of Receipt letter with a file number and information on processing times

The officer will review your application to determine whether:

• your application qualifies for processing under one of the three categories described in the Ministerial Instructions minimum requirements

•selection factors

•sufficient funds (Show Money Settlement Funds)

3. If the Embassy is satisfied with the documents provided they will now issue the VISA for the entire Family

Before we received our first Notice of Assessment from the CIO I tell my clients that the interval between the first and second stage is one to three months, speculating on the publications of the Citizenship and Immigration Canada.

It turned out to be much much faster!

The next step after receiving the notice of assessment from CIO is the submission of full application (application forms and supporting documents) to the Visa Office. This client was given 120 days to comply(only 4 months then you can get your Visa).

This is how fast you can get your Visa, at present within 6 months time!

It is not only you that has intentions of going to Canada, because of the good quality of life in Canada, more and more applications are being Sent to The Centralized Intake Office (CIO).

POEA and online job applications for Canada

The POEA is a government agency tasked to monitor and oversee, the employment of our countries Overseas Filipino Workers - OFW.

I have, of late, written numerous articles about the Philippine Overseas Employment Administration POEA, to educate my readers that there is a website that they can regularly vesit to gain news and insights about working overseas. POEA and online Job applications for Canada, is written to make the readers aware of the various online employment scams in the internet and how by visiting th POEA website the reader will be aware about them.

If you have received an invitation for an online Job application for Canada, you should read the email message carefully and determine if the offer is for real or it is just one of the on-line job scams that has been circulating around the World Wide Web.

There are certain similarities in these scams that you can easily spot such as:

1. The use of a free email address. These adds will normally be sent using either google or yahoo or other free email subscriptions. Remember that a big company who requires so many workers would normally have their own domains and uses a company email address.

2. Very high Salary offers for low skilled jobs. The minimum wage for Canada is only approximately Cn$8.00 per hour. If you multiply this for 40 hours a week time 4 weeks, you will end up with Cn$ 1,280.00 per month. Yet these Job offers would normally claim that they will pay $4000 to $5000 for a low skilled job such as cleaner or factory worker.

3. The request for payment for so called Visa processing Fees coursed through Western Union or Postal money order. Again Big companies have their bank accounts. Where to put up this accounts they were required certain documents to prove the existence of their companies. You should also know that under the laws of the Philippines and Canada, most of the recruitment cost will be shouldered by the employer not the employee. You may read POEA guidelines.

Although, this individuals who engage in Job Scams are sometimes very clever, they would sometimes use the website details of other existing companies to make it appear that they are members of the organization.

That is why the first thing that you should do is to ask for the contact information of the company:

1. Website
2. Telephone number
3. Company representative

And always ask what the payment is for. I would like to repeat, most of the provinces of Canada prohibits the charging of any fees for the worker.

The POEA has a section in their website where they publish scams that they have already encountered. They have guidelines that you can read to easily catch individuals who pose as an employer you may read the Top 10 internet scams.

There are also sample letters that they have compiled for you to read.

I am not saying that all online Job applications for Canada or should I say Online Job offers are all scams, but it pays to be careful.

POEA and Jobs in Canada

Being a consultancy firm that handles immigration and work Visa application for Canada, I usually get questions about POEA and Jobs in Canada seeing the various television commercials featuring the Job opportunities for that Country.

Somehow people have the impression that POEA offers jobs, or is the one who is distributing Jobs for Canada.

The confusion is brought about by the series of News about Canadian Jobs offered to Filipinos and the memorandum of agreements signed between DOLE and POEA aimed to protect Filipino Workers.

The television networks highlighted POEA and Jobs in Canada. Some of my clients even went to the POEA bringing with them their resumes, only to find out that there are no Jobs being offered by POEA.

POEA is a government agency that regulates the overseas placement of Filipinos.

The POEA sent out an advisory to explain and it reads:

POEA’s government placement facility has no job openings for Canada. There are about
109 POEA-licensed private recruitment agencies that have approved job orders for
registered employers/principals in Canada for the recruitment of skilled workers and

Philippine Overseas Employment Administration (POEA)

As an Overseas Filipino Worker (OFW) you should constantly visit the website of the Philippine Overseas Employment Administration (POEA). At the very least just to check on the OFW advisories, new Announcements and Stop Illegal recruitment section of the website.

This practice will not only insure that you are up to date with the latest regulations it would also protect yourself and your family member who also has plans of working outside of the Philippines.

The Philippine Overseas and Employment Administration is Government agency that promotes and monitors overseas employment of the country's labor expatriates. Its website is updated regularly, it is here that you will also see the scams that are rampant from illegal recruiters worldwide.

As a blog dedicated to help Filipinos Immigrate to Canada, I am aiming to direct your attention to the section of the POEA website that discusses the current agreements between the Philippine government and that of Canada with regards to Canadian overseas employment opportunities.

Is the reason why you want to visit the POEA website, because you are looking for a Job? Or is it because you want to check the authenticity of a certain Job offer?

If the job vacancy published was seen by you in an advertisement on a local paper or sent to you online job applications or was posted by a recruitment agency (either a foreign placement agency or a local employment agency); verify, first, to make sure the agent you are dealing with is authorized or licensed by POEA (Philippine Overseas Employment Administration) and has the proper job order and the person transacting business with you is legitimately connected with the licensed agency. You should apply only at the registered office of the recruitment agency.

You can easily verify if a particualar Recruitment agency has the proper license to conduct recruitment activities by going to the online services of the POEA. There you can see if the agency really has the job offer that it is advertising.

If the recruitment is conducted outside the registered office address, verify if it has a provincial recruitment authority issued byPOEA or has been allowed to conduct recruitment activity outside their office. You must ask for a copy of employment contract and study the terms and conditions. Never pay the any fees unless you have been hired and signed the employment contract. Always ask for a receipt corresponding to any payment

Agencies shall charge from their principals a service fee to cover services rendered in the recruitment, documentation and placement of workers.

Documentation costs to be paid by the worker shall include, but not limited to, the following: a. Passport

b. NBI/Police/Barangay Clearance
c. Authentication
d. Birth Certificate
e. Medicare
f. Trade Test, if necessary
g. Inoculation, when required by host country
h. Medical Examination fees

By the laws of the Philippines as well as that of Canada, it is mostly the employer who has to pay most of the cost related to hiring the Filipino worker.

POEA guidelines for Filipino workers bound for Canada

This post aims to simplify the POEA guidlines for Filipino workers for workers bound for Canada.

If you are a Canadian Employer or a Filipino worker with plans of working in Canada it is important that you read this article.

I. Coverage of POEA circular applies to to Employers/principals who are hiring filipino professionals, skilled workers, caregivers and other skilles for Canada.

II. The registration requirement of Principals/Employers are as follows:

1. All Canadian Principals and Employers must submit all recruitment and employment documets through a licensed recruitment agency, to the POEA, for the registration of the Employer/Principal.
2. Said documents must be duly verified by the Philippine Overseas Labout Office (POLO) which are as follows:

a. Special Power of Attorney (SPA) from the Principal authorizing the POEA licensed recruitment agency from the Phillipines. If the principal/employer is a licensed placement agency in Canada, an SPA must be issued from the employer in Canada to the Canadian recruitment Agency, authorizing the Canadian recuitment Agency to recruit for the Canadian Employer.
b. Manpower Request (MR) indicating the position and salary of the workers to be hired. In case that the Principal is a Canadian Placement agency, the Job Order (JO) from the Canadian Employer must be included indicating the details of manpower demand addressed to the placement agency.
c. Copy of the pre-approved Labour Market Opinion (LMO/E LMO) from the service Canada or approval of application to the Provincial Nominee Program Certificate of Nomination, if applicable.
d. Copy of the business license or comercial registration of the Principal/Employer. To clarify, if a Canadian recruitment company is involved, both permits from the Canadian Recruitment Agency and the Employer in Canada will be submitted.
e. Master Employment Contract, again if the principal is a foreign placement agency, the master contract of the employer in Canada to the Filipino workers shall be submitted.

3. For approval of additional Job Orders the following documents duly verified by the POLO shall be submitted to the POEA:

a. Manpower Request
b. Pre-Approval of LMO/E LMO or equivalent document like the PNP Certificate if applicable.

4. The maximum validity of registration for Principal/Employers will be for four (4) years unless sooner revoked by the POEA for the following grounds:

a. Expiration of the Principals Business permit/license.
b. Upon mutual written agreement by the parties to pre-terminate the agreement.
c. False documentation or misrepresentation in connection with the application registration.
d. Final judgement in disciplinary action against the foriegn principal.
e. Cancellation of license of the local agency

5. Validity of Manpower Requests/Job Orders. A principal Employer that acts as a regular employer (not a Foreign placement agency) may be registered to more than one Philippine licensed recruitment agency provided that:

a. The same compensation package are adopted by the principal and the agency;
b. The verified job order is more than 50 workers
c. The principal must have hired at least 50 workers within a period of one year immediately preceding the registration;

A principal that is licensed to operate as a placement agency in Canada may be registered to a maximum of 2 Philippine POEA licenced agency subject to the same conditions as above.

III. Requirements of Workers to get POEA exit are the following:

1. Processing of Agency hires. Documentation of agency hired OFW's shal require the following:

a. For regular processing.

a.1 Duly accomplished Request for Processing Form
a.2 Workers Information Sheet
a.3 Labour Market Confirmation (LMO confirmation) issued by Service Canada indicating the name of hired Overseas Filipino Worker or Provincial Nominee Certificate of Nomination, if applicable.
a.4 Verified individual employment contract (if caregiver)

b. Electronic Submission of Contracts for Processing

Upon encoding and electronic submission of worker and principal information by the Philippine Agency, the LMO Confirmation issued by Service Canada indicating the name of the hired OFW or Provincial Program Certificae, if applicable and the verified individual employment contract (if Caregiver) shall be presented to the POEA prior to assessment and payment of procesing fees.

2. Processing of Name Hires (for employers who only needs 5 or less employees within one year)

a. Requirements:

a.1 Employment contract signed by worker and employer verified by POLO
a.2 Labour Market Opinion Confirmation issued by Service Canada
a.3 Copy of passport with stamped valied employment VISA
a.4 Pre Departure Orientation Seminar (PDOS) Certificate

IV. New Market the following documents duly verified by the POLO are required for agency license for th Issuance of the Certificate of New Market:

1. SPA of the Attorney form the Principal(s) to the applicant Agency
2. Pre-approval of LMO or E LMO or approval to the Provincial Nominee Program
3. Manpower request(s) for 100 workers

V. Cost of recruitment

As required by both the Philippine as well as the Canadian goverment, it is the the responsibility of the employer to pay for all recruitment cost related to hiring Filipino workers. These consists of worker's visa Fee, airfare, POEA processing Fee, OWWA membership contribution, trade test and cost of training, if required by employer.

Ther worker shall be responsible for the cost of passport, NBI clearance, birth certificate, medical examination and health insurance.

Fees and Costs

POEA Processing Fee - US$100 or its peso equivalent
OWWA membership fee - US$25 or its peso equivalent
OWWA Medicare - Php900.00

Required Documents

You shall be issued an Overseas Employment Certificate (OEC), which serves as the OFW travel exit clearance at the airport and immigration counters. The OEC is also an exemption for OFWs from payment of travel tax and airport terminal fees. You shall likewise get a free OFW electron ID card or e-Card, which is your permanent identification card to facilitate your departure and access to services as OFW

VI. Placement Fee

Philippine agencies are prohibited from charging any recruitment and placement fee from workers to be deployed to the provinces of Saskatchewan, Manitoba, British Colombia and Alberta and other provinces of Canada which laws prohibit the collection of recruitment fees. Philippine agencies shal charge the employers the cos for its services.

Canadian Immigration Lesson

From 2003 until 2008 it used to be that there were more than 300 occupations eligible to apply for Federal Skilled Workers class immigration for Canada.

The government of Canada has opened this portal for you to go to Canada, but this is for a limited time only. Once they receive their desired number of applicants for a particular occupation, they will definitely close this program.
